TERMS & CONDITIONS OF SERVICE

1. AGREEMENT TO TERMS
By visiting www.socherie.com or any other digital property that we operate (collectively, the “Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions of Service (the “Terms”). If you do not agree, you must immediately discontinue use of the Site and any services or products (“Products”) offered through it. These Terms form a binding contract between you and SoChérie, LLC (“SoChérie,” “we,” “our,” or “us”).
2. ELIGIBILITY
You must be 18 years or older and able to enter into legally binding contracts to access or use the Site or to purchase Products. By using the Site, you represent and warrant that you satisfy these eligibility requirements.

7. ORDERS, PRICING & AVAILABILITY
7.1 Order Acceptance
Receiving an order confirmation email only acknowledges that we received your order; it does not signify acceptance. A binding sales contract is formed once we email you a shipping confirmation indicating your order has left our fulfillment center.
7.2 Pricing Errors
Prices, descriptions, and availability can change without notice. If we discover an error in your order’s price or availability, we will contact you for instructions before processing or cancel the order and fully refund any payment received.
7.3 Payment
You authorize us (or our payment processor) to charge the payment method you supply for the total amount of your order, including any applicable taxes and shipping fees.
7.4 Shipping, Risk of Loss & Title
Title to Products and risk of loss pass to you upon our delivery to the carrier. Delivery dates are estimates only.

UNDER NO CIRCUMSTANCES SHALL SOCHÉRIE OR ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 15. BINDING ARBITRATION & CLASS ACTION WAIVER
15.1 Agreement to Arbitrate
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or Products (collectively, “Disputes”) shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, except that either party may bring an individual action in small-claims court. The Federal Arbitration Act (“FAA”) governs this agreement.
15.2 Class & Jury Trial Waiver
You and SoChérie waive any right to participate in a class action or class-wide arbitration. Disputes shall be arbitrated only on an individual basis, and each party waives the right to a jury trial.
15.3 Opt-Out
You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@socherie.com with your name and a clear statement that you wish to opt out. Opting out will not affect any other provisions of these Terms.
16. GOVERNING LAW
These Terms and any Dispute shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict-of-law provisions, and the FAA for arbitration matters.
17. TERMINATION
We reserve the right, without notice and in our sole discretion, to suspend or terminate your right to use the Site or Products, and to block or prevent future access to and use of the Site, if you violate these Terms or our policies, or for any other reason.
18. SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severed and shall not affect the validity or enforceability of the remaining provisions.
19. ENTIRE AGREEMENT
These Terms, together with any policies or legal notices posted on the Site, constitute the entire agreement between you and SoChérie regarding the Site and supersede all prior or contemporaneous communications.
